These Terms and Conditions apply to each quote issued by Ropke Land Services LLC (“Ropke Land Services”) that references or links to this page. By electronically approving a quote, signing it, paying a deposit, or authorizing work to begin, the customer accepts the quote and these Terms and Conditions.
If a quote conflicts with these general Terms and Conditions, the specific terms stated in the quote will control.
Scope of Work
Ropke Land Services will provide the labor, equipment, materials, and services specifically described in the approved quote. Work not included in the quote is considered additional work and may require customer approval and additional charges.
Unless specifically included in the quote, the work does not include permits, surveys, engineering, private utility locating, finish grading, seeding, sod, landscaping, pavement repair, or restoration of disturbed areas.
Quotes and Scheduling
Quotes are valid for 30 days unless otherwise stated. Proposed dates are estimates and may change due to weather, unsafe conditions, saturated or frozen ground, material or equipment availability, utility-location delays, emergencies, or circumstances beyond the reasonable control of Ropke Land Services.
Ropke Land Services may delay or suspend work when conditions could create a safety concern, cause unnecessary property damage, or prevent the work from being completed properly.
Customer Responsibilities
The customer is responsible for:
- Providing safe and reasonable access to the work area.
- Identifying property lines, easements, restricted areas, and known hazards.
- Obtaining required permits, surveys, association approvals, and property-owner permissions unless the quote states otherwise.
- Identifying private or unmarked underground items, including septic systems, drain fields, irrigation, wells, invisible fencing, propane lines, electrical lines, drainage systems, and buried structures.
- Removing or protecting vehicles, pets, people, decorations, furniture, and other personal property near the work area.
- Ensuring that Ropke Land Services has permission to enter the property and perform the approved work.
The customer should notify Ropke Land Services before work begins of any driveway, culvert, lawn, utility, structure, or access route that may not support heavy vehicles or equipment.
Utilities and Underground Conditions
Ropke Land Services may rely on markings provided by public utility-location services, private locators, and the customer. Unless specifically included in the quote, locating private utilities and underground improvements is the customer’s responsibility.
Ropke Land Services is not responsible for damage to private, unmarked, incorrectly marked, or undisclosed underground items. Additional work resulting from rock, buried debris, unsuitable soil, concealed structures, unknown utilities, or other unforeseen site conditions may result in additional charges or schedule changes.
Changes and Additional Work
Changes requested by the customer must be approved by Ropke Land Services and may affect the price and schedule. Approval may be provided electronically or in writing.
If unforeseen conditions require additional labor, equipment, materials, disposal, or repairs, Ropke Land Services will notify the customer before proceeding whenever reasonably practical.
In an emergency involving an immediate safety risk or threat of property damage, Ropke Land Services may perform reasonably necessary protective work when the customer cannot be reached. The customer will be notified as soon as reasonably practical, and the work may be billed as an additional charge.
Job-Specific Conditions
Each job may involve conditions or requirements that are not reasonably known when the quote is prepared. Any special assumptions, exclusions, allowances, unit prices, or responsibilities stated in an individual quote will become part of the agreement.
If unexpected conditions materially change the work, cost, or schedule, Ropke Land Services will notify the customer before proceeding whenever reasonably practical. Additional work will require customer approval, except for limited work reasonably necessary to protect people, equipment, or property from an immediate risk. Approval may be provided electronically or in writing.
Property Access and Site Disturbance
The customer authorizes reasonable access by Ropke Land Services vehicles, equipment, members, employees, and subcontractors. Land-service work may disturb lawns, soil, landscaping, driveways, culverts, access routes, or nearby areas, especially when heavy equipment is required.
Ropke Land Services will use reasonable care but is not responsible for ordinary ground disturbance, rutting, compaction, or wear reasonably associated with the approved work. Any restoration promised by Ropke Land Services must be specifically listed in the quote.
Completion and Customer Review
The customer should inspect the work promptly after completion and notify Ropke Land Services of any concern within seven days. Ropke Land Services must be given a reasonable opportunity to inspect and, when appropriate, correct its work before the customer hires another contractor or incurs repair costs.
Minor settling, erosion, changes caused by severe weather, and conditions resulting from customer actions or existing site conditions are not considered defective work.
Payment
The customer agrees to pay deposits, progress payments, and final balances according to the quote and invoice. Unless otherwise stated, final payment is due upon completion.
Approved changes, additional work, unforeseen conditions, special-order materials, disposal fees, and other costs outside the original scope may be billed separately. Ropke Land Services may suspend work or withhold further scheduling while an amount is past due.
Past-due balances may be subject to late charges disclosed on the quote or invoice, along with reasonable collection costs permitted by law.
Cancellation and Rescheduling
The customer should provide reasonable notice of cancellation or rescheduling. The customer remains responsible for completed work, mobilization costs, special-order or nonreturnable materials, cancellation fees charged by suppliers or subcontractors, and other nonrecoverable costs incurred for the job.
Any legally required right to cancel remains unaffected by this section.
Workmanship and Site Conditions
Ropke Land Services will perform the quoted work in a reasonable and workmanlike manner. Any specific warranty must be stated in the quote.
Ropke Land Services does not guarantee results affected by weather, erosion, drought, excessive moisture, soil conditions, natural settling, seed germination, plant survival, drainage originating outside the work area, improper maintenance, or later work performed by the customer or another party.
Photos and Job Documentation
Ropke Land Services may photograph or record the work area before, during, and after the job for estimating, documentation, safety, quality control, advertising, and promotional purposes, including use on its website and social media.
Ropke Land Services will not publish the customer’s name, street address, license plate, or other identifying personal information without the customer’s permission. When reasonably practical, identifying details visible in a photograph will be removed, obscured, or excluded before publication.
Limitation of Responsibility
To the extent permitted by law, Ropke Land Services is not responsible for delays or damages caused by severe weather, acts of government, utility-location errors, unknown site conditions, customer-provided information, third parties, or other circumstances outside its reasonable control.
Nothing in these Terms and Conditions limits any right or remedy that cannot legally be limited.
Electronic Communications and Acceptance
The customer agrees that quotes, approvals, change orders, invoices, receipts, scheduling notices, and other job-related communications may be provided electronically.
Electronic approval of a quote, payment of a deposit, or authorization for Ropke Land Services to begin work confirms acceptance of the quote and the version of these Terms and Conditions linked to it at that time.
